Terms and Conditions of Sale

These Terms and Conditions of Sale (the “Terms of Sale”) govern sales concluded between, on the one hand, any individual or legal entity wishing to make a purchase through www.jtracingusa.fr (the “Customer”) and, on the other hand, TSUKAWA, registered under SIRET number 943 236 646 00023, whose registered office is located at 37 rue de charbonnière, 45800 St Jean de Braye, France (the “Seller”).

1. Purpose

These Terms of Sale define the rights and obligations of the parties in connection with the online sale of products offered by the Seller to the Customer through www.jtracingusa.fr.

2. Products

The products offered for sale are those described on the website. The Seller endeavours to present the essential characteristics of the products. However, minor differences may exist between the images shown and the products delivered.

3. Orders

The Customer places an order through the website. Any order implies full acceptance of these Terms of Sale. Once the order has been confirmed and payment accepted, a confirmation email is sent to the Customer.

4. Prices

Prices are shown in euros, including all taxes, excluding delivery charges. The Seller reserves the right to change prices at any time. The applicable price is the price in force when the order is confirmed.

5. Payment

Payment is due immediately when the order is placed. Payments may be made by bank card, PayPal or any other payment method offered on the website. Transactions are secured using an encrypted payment system.

6. Delivery

Deliveries are made to the address provided by the Customer when placing the order. Delivery times are given for guidance only. If a delay exceeds 30 days, the Customer may request cancellation of the order and a refund.

7. Right of withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of the products to exercise the right of withdrawal without having to give a reason.
Returned products must be new, unworn, unwashed and in their original packaging. Return shipping costs remain the responsibility of the Customer.

8. Warranties

Products benefit from the French statutory guarantee of conformity (Articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of non-conformity or a defect, the Customer must contact customer service.

9. Liability

TSUKAWA cannot be held liable for damage resulting from improper use of purchased products. Its liability is limited to the amount of the order.

10. Personal data

TSUKAWA undertakes to respect the confidentiality of personal data provided by the Customer. This data is processed in accordance with the General Data Protection Regulation (GDPR). The Customer may exercise rights of access, rectification or deletion by contacting customer service by email.

11. Intellectual property

All elements of www.jtracingusa.fr are protected by copyright, trademarks or patents. Any total or partial reproduction is strictly prohibited without TSUKAWA’s prior written permission.

12. Governing law – Disputes

These Terms of Sale are governed by French law. In the event of a dispute, an amicable solution will be sought. Failing this, the competent court will be the court having jurisdiction over the Seller’s registered office.
